Scotia iTRADE® Stock Shopping Spree Contest

Official Contest Rules & Regulations.

* NO PURCHASE NECESSARY. By entering the Scotia iTRADE Stock Shopping Spree Contest (the "Contest"), entrants agree to abide by these Official Contest Rules and Regulations and to the decisions of Scotia iTRADE (the "Sponsor"), which are final.

At the end of the Contest Period, you will have the chance to win 1) one (1) stock shopping spree into a Scotia iTRADE account of up to $10,000 (the "Grand Prize") or 2) one (1) of five (5) $1,000 cash deposits into a Scotia iTRADE account (each, a "Secondary Prize", and each Secondary Prize and Grand Prize, a "Prize")

ELIGIBILITY

To be eligible for the Contest prizes, all entries must be received during the Contest Period. The Contest is open to residents of Canada (except for the residents of the Province of Quebec), who have reached the age of majority in their province/territory of residence as of May 9, 2016. The Contest excludes the employees, representatives, agents, directors and  officers  of The Bank of Nova Scotia, its subsidiaries and its affiliates, as  well as those with whom such persons are domiciled, whether related or not, and their respective advertising and promotional agencies or their representatives. All entries become the property of Scotia iTRADE. Scotia iTRADE assumes no responsibility for any incomplete, misidentified or misdirected entries or for any other such problems occurring in connection with participation in this Contest. 

CONTEST PERIOD

The Contest Period to enter is from Monday, May 9, 2016, 8:30 a.m. Eastern Time ("ET") to Sunday, July 31, 2016, 11:59 p.m. ET (the "Contest Period"). 

HOW TO ENTER

NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.

You will automatically be entered and will receive one ballot if you are a new Scotia iTRADE client and you open a new Scotia iTRADE account (a "New Account") between May 9, 2016 and July 31, 2016.  If you fund such New Account between May 9, 2016 and August 31, 2016 (the "Funding Period") with at least $25,000 in cash or in Net Equity (cheque deposit or transfer of assets) (the "Minimum Amount") from an account that is not held at Scotia iTRADE  and then maintain the Minimum Amount in assets that you deposited in your New Account during the entire period between September 1, 2016 and November 30, 2016 (the "Holding Period"), you will automatically receive additional ballots.

The number of ballots you may receive depends on the amount of funding made to your Scotia iTRADE account during the Funding Period and held during the Holding Period. You will automatically receive the following number of ballots if you fund your New Account during the Funding Period and hold such amount during the Holding Period: a total of 5 ballots if you fund and hold at least $25,000 and less than $50,000; a total of 10 ballots if you fund and hold in your account at least $50,000 and less than $100,000, a total of 25 ballots if you fund and hold in your account at least $100,000 and less than $250,000; a total of 50 ballots if you fund and hold in your account at least $250,000 and less than $500,000; a total of 100 ballots if you fund and hold in your account at least $500,000 and less than $1,000,000; and a total of 200 ballots if you fund and hold in your account at least $1,000,000.

If you do not meet the conditions for automatic entry as described above and wish to enter the contest, you may enter online by completing an entry form here to receive one ballot in the contest. Limited to one entry per person.

To determine the amount funded in your account by August 31, 2016 (the "Funded Amount"), the amount of the funds transferred out of the relevant new account between the date of your entering the Contest and August 31, 2016 will be subtracted from the amounts of the funds transferred into the account between the date of your entering the Contest and August 31, 2016.  If the resulting amount is below the Minimum Amount, no ballots will be awarded. The funds are eligible to be included in the calculation of the Funded Amount only if they are received by Scotia iTRADE between May 9, 2016 and August 31, 2016.

To determine the amount of the funds maintained in the account between September 1, 2016 and November 30, 2016, any funds withdrawn from the account between September 1, 2016 and November 30, 2016 will be subtracted from the Funded Amount. All entries are subject to verification. Scotia iTRADE reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to Scotia iTRADE) to participate in the Contest. Failure to provide such proof in a timely manner may result in disqualification. By entering the Contest, you agree to be bound by the decisions of Scotia iTRADE, which are final and binding without right of appeal with respect to all matters relating to the Contest.

DRAWING AND PRIZES

Scotia iTRADE will conduct the Prize draw on January 31, 2017 (the "Draw Date"). There is one (1) Grand Prize and five (5) Secondary Prizes available to be won at the end of the Contest. Scotia iTRADE will randomly draw, first, one (1) potential winner of the Grand Prize and then five (5) potential winners of the Secondary Prizes from among all eligible entries submitted during the whole Contest Period.

GRAND PRIZE

The winner of the Grand Prize will win a stock shopping spree to purchase up to $10,000 in securities listed on the Toronto Stock Exchange (the "TSX") into a new or existing Scotia iTRADE account. After being declared the winner of the Grand Prize, such winner will be entitled to select up to 10 different types of securities listed on the TSX as identified by their stock symbol with an aggregate purchase price of up to $10,000. The winner of the Grand Prize will not be responsible for any commissions to Scotia iTRADE in connection with the initial acquisition of the securities comprising the Grand Prize.

SECONDARY PRIZES

Five (5) secondary prize winners will each receive $1,000 cash deposited into a new or existing Scotia iTRADE account.

GENERAL

The Grand Prize and the five (5) secondary prizes are expected to be delivered by April 30, 2017, subject to satisfactory completion of any conditions set out herein.

The potential Prize winners will be contacted within five (5) business days of the Draw Date in order to be confirmed as Prize winners, as further described below.

In order to be declared a Prize winner, in addition to complying with the terms and conditions of these Official Contest Rules and Regulations, the selected entrant must be eligible to and must open an account with Scotia iTRADE or, if the selected entrant is an existing Scotia iTRADE client all of such entrant's accounts at Scotia iTRADE must be in good standing as of February 28, 2017.

Should a selected entrant fail to meet any conditions in these Official Contest Rules and Regulations, he/she will be disqualified. Scotia iTRADE reserves the right in its sole and absolute discretion to conduct a new random draw from amongst all remaining eligible entries in accordance with these Official Contest Rules and Regulations in order to select another entrant, who will be subject to disqualification in the same manner.

All dollar amounts mentioned are in Canadian dollars. The Prizes must be accepted as awarded and are non-transferable.  If a Prize winner does not have a Scotia iTRADE account, the winner must open a new Scotia iTRADE account in order to receive the  Grand Prize or Secondary Prize, as applicable, into that Scotia iTRADE account. There is no cost for opening a Scotia iTRADE account; however there may be fees associated with particular investments, as well as administrative fees.

Scotia iTRADE reserves the right to substitute the Prizes or Prize components with one of equal or greater value and/or to terminate, modify or withdraw this Contest, in whole or in part, at any time, without prior notice for any reason including, but not limited to viruses, bugs, tampering or other causes beyond Scotia iTRADE's control affecting the administration, security, fairness or proper play or conduct of the Contest. In the event a substitute prize is awarded, such prize must be accepted as awarded and cannot be exchanged for cash or otherwise. Scotia iTRADE will not be responsible if any factors beyond their reasonable control prevent the Prize from being fulfilled. Scotia iTRADE is not responsible for providing insurance, financial or tax advice.

If a winner does not utilize any part(s) of a Prize, then any such part(s) not utilized will be forfeited in its entirety and nothing will be substituted in its place.  Scotia iTRADE reserves the right at any time to place reasonable restrictions on the availability or use of the Prizes or any component thereof. By accepting a Prize, the winner agrees to waive all recourse against the Releasees (defined below) if such Prize or a component thereof does not prove satisfactory, either in whole or in part.

CERTIFICATION AND ACKNOWLEDGEMENT

By entering the Contest, you certify that:

  1. You have read  and  agree to be bound by these Official Contest Rules and Regulations;
  2. You agree to complete a release in favour of Scotia iTRADE, its respective affiliates and partners described below;
  3. You acknowledge and  agree that  Scotia iTRADE may, in its sole  discretion, disqualify your entry if it finds that  (i) you have not complied  with your certification  in this section "Certification and Acknowledgement",  (ii) you have  failed to meet or abide by, or violated,  these  Official Contest Rules and Regulations, or (iii) you have  tampered with the  entry  process or any other component of the Contest, which conduct or action affects the administration, security or fairness, integrity or proper conduct of the Contest. Scotia iTRADE reserves the right to refuse an entry from any person whose eligibility is in question or who has been previously disqualified.

CHANCES OF WINNING

For the Prizes, your chances of winning depend on the total number of eligible entries Scotia iTRADE receives during the whole Contest Period. Scotia iTRADE's decisions are final and binding in all respects on all entrants.

DECLARATION AND RELEASE OF PRIZE WINNERs

Scotia iTRADE will contact the selected winners at the email and/or telephone number provided within five (5) business days of the applicable Draw Date. At such time, the selected entrants will be required to correctly answer, unaided, a time-limited mathematical skill-testing question to be administered on behalf of Scotia iTRADE and confirm their eligibility. In the event  that Scotia iTRADE cannot contact the selected  winners in three  (3)  attempts or within five  (5)  business days  after the Draw Date (whichever happens first),  the selected winners  will be disqualified  and Scotia iTRADE reserves the right, in its sole and absolute discretion,  to randomly choose alternate entries in accordance with these Official Contest Rules and Regulations. The selected winners will be provided with the liability and  publicity release forms, releasing the Releasees from any and all liability arising from, among other things: (i) participation in the Contest; and (ii) acceptance of the prizes awarded therein; and (iii) the administration of the Contest and the award of the Prizes in this Contest.

If any of the selected entrants do not meet any conditions of these Official Contest Rules and Regulations, fail to answer the skill-testing question correctly, do not sign and return Scotia iTRADE's standard form of Declaration of Liability, Waiver and Publicity Release (the "Release") within ten (10) business days of being contacted by Scotia iTRADE's representatives or agents, or contact cannot be made within five (5) business days from the time Scotia iTRADE's representatives or agents provide it to them, those entrants will be disqualified. Scotia iTRADE reserves the right, in its sole and absolute discretion, to select new eligible entrants from all remaining eligible entries received during the Contest Period. Scotia iTRADE is not responsible, whether as a result of human error or otherwise, for any failure to contact any potential winners.

RELEASE OF LIABILITY

Scotia iTRADE, its affiliates, partners, and  all of their  directors, officers,  employees, agents, promotional agencies and  partners, (collectively, the "Releasees") assume no responsibility for any failure  or technical  malfunction  of any Web site, on-line  computer systems of equipment, servers, access providers or software, poor  reception or technical problems, or for any failure  of any email or submission to be received by the  Releasees on account of technical problems, human  error or traffic congestion on the  Internet or at any  Web site. The Releasees further assume no liability for any injury or damage to an entrant's or any other person's computer or other property related to or resulting from  participating in this Contest or from accessing, allowing or downloading  any  material relating  to the  Contest.

CONSENT TO USE OF PERSONALITY

Subject to applicable law, by entering the  Contest, you consent to the use of your  name, city of residence, photograph, voice, likeness, image  or any  other aspect of your  personality, for any  publicity and  programming purposes, commercial or otherwise, in all media  that  Scotia iTRADE uses, without territorial or time  limitations, and without payment or compensation. You give the same consent to Scotia iTRADE's affiliates, promoters and their advertising and promotional agencies.

CONSENT TO COLLECTION AND USE OF PERSONAL INFORMATION

Scotia iTRADE respects your right to privacy. By entering the Contest and  voluntarily  providing  personal information  including, but not limited to, name, e-mail  address and  telephone number (the  "Registrant Information"), you  expressly consent to Scotia iTRADE, its agents and/or representatives, its affiliates and  partners collecting, storing, sharing, using and disclosing  the Registrant Information for the purpose of administering the Contest and selecting the Prize winners in accordance with Scotia iTRADE's privacy policy, available at  http://www.scotiabank.com/itrade/en/0,,4263,00.html.

In addition, if you are not an existing Scotia iTRADE client and if you provide your consent to these Official Rules and Regulations at the time of entering the Contest, Scotia iTRADE will  store and use your Registrant Information for future mail and phone marketing of its products and services to you and may contact you by mail, phone or pre-recording voice messages to  provide you with information regarding Scotia iTRADE's products, services, upcoming promotions and/or events from Scotia iTRADE and for any other purposes required or permitted by law and in accordance with Scotia iTRADE's privacy policy. If you are an existing Scotia iTRADE client, the consent or preferences you have given or may give regarding the collection, use and disclosure of your personal information will govern such collection, use and disclosure. Please direct any questions or comments regarding this Contest to Scotia iTRADE.

COMPLIANCE WITH CONTEST RULES

All entrants agree to follow these Official Contest Rules and Regulations, which are subject to change at Scotia iTRADE's sole discretion. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws. Should such an attempt be made, Scotia iTRADE reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

COMPLIANCE WITH LAWS

The Contest is void where prohibited by law and is subject to all applicable Canadian federal, provincial and municipal laws and regulations.

GENERAL TERMS AND CONDITIONS

(1) Entries which are incomplete or fraudulent are null and void.

(2) By entering this Contest, you agree to hold harmless the Releasees against any and all liability, damages or causes of action (however named or described) with respect to or arising out of: (i) your participation in the Contest, (ii) the receipt or use/misuse of the Prizes awarded herein, including any travel related thereto; and (iii) the administration of the Contest and award of the Prizes.

(3) Scotia iTRADE does not assume any responsibility and will not be liable for any failure of the websites used for conducting the Contest during the Contest, tampering, theft, defects, viruses, human errors including negligence, deletions, technical or telephone, computer line, network, server, access providers, computer equipment or software problems, undeliverable messages, computer errors, lost, misdirected, late or incomplete entries or inaccurate capture of information or any online difficulties that may result in computer damage or malfunction or the failure of Scotia iTRADE to receive or process any entry and otherwise award the Prizes. Scotia iTRADE is not responsible for printing errors appearing in these Official Rules and Regulations or related Contest materials.

(4) In addition, Scotia iTRADE will not assume any responsibility of any nature whatsoever in all cases where its inability to hold the Contest or to remit the Prizes to the winner results from a cause beyond their control, including acts of God, weather conditions, strikes, lock-outs or other labour disputes.

(5) Scotia iTRADE reserves the right to withdraw or amend this Contest in any way without prior notice. Scotia iTRADE can do this for any reason, including, in the event of an error, tampering, unauthorized intervention, fraud or any other cause beyond the reasonable control of Scotia iTRADE that interferes with the proper conduct of this Contest as contemplated by these Official Contest Rules and Regulations.

(7) In the event of any inconsistency between these Official Contest Rules and Regulations and any advertising or other materials related to the Contest, these Official Contest Rules and Regulations will govern.
