Official Contest Rules & Regulations.

NO PURCHASE NECESSARY. By entering the Take a Selfie at the Scotia iTRADE Investor Centre at Scotia Plaza Contest (the “Contest”), entrants agree to abide by these Official Contest Rules and Regulations and the decisions of the sponsor, Scotia iTRADE, which are final.

ELIGIBILITY

To be eligible for a Prize, all entries must be received during the Contest Period. The Contest is open to all legal residents of Canada, other than the residents of Quebec, who have reached the age of majority in their province/territory of residence as of July 2, 2015. The Contest excludes the employees, representatives, agents, directors and officers of The Bank of Nova Scotia, its subsidiaries and its affiliates (as well as those with whom such persons are domiciled, whether related or not), and their respective advertising and promotional agencies, Prize suppliers or their representatives. Scotia iTRADE assumes no responsibility for any incomplete, misidentified or misdirected entries or for any other such problems occurring in connection with participation in this Contest. 

CONTEST PERIOD

The Contest Period is from Thursday, July 2, 2015, 8:30 a.m. Eastern Time (“ET”) to Friday, July 31, 2015, 5:00 p.m. ET (the “Contest Period”). 

HOW TO ENTER

During the Contest Period, you will have the chance to win 1 (one) of 50 (fifty) Cineplex Movie Passes (each, a “Prize”), each Prize retail valued at $13.

To enter the Contest, visit the Scotia iTRADE Investor Centre on the concourse level of Toronto Scotia Plaza located at the Plaza Concourse, 44 King Street West, Toronto (see map here). Take a selfie of yourself at the branch, follow @Scotia_iTRADE and tweet your photo with #ScotiaPlaza and @Scotia_iTRADE in your tweet telling your followers that you are at the Scotia Plaza (“Scotia Tweet”).

Once your Scotia Tweet is posted on Twitter and verified by Scotia iTRADE, you can receive 1 (one) prize IF your Scotia Tweet is among the first 50 Scotia Tweets posted on Twitter during the Contest Period. Only 1(one) contest entry per person is permitted.

All entries are subject to verification. Scotia iTRADE reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to Scotia iTRADE) to participate in the Contest. Failure to provide such proof in a timely manner may result in disqualification. By entering the Contest, you agree to be bound by the decisions of Scotia iTRADE, which are final and binding without right of appeal with respect to all matters relating to the Contest.

PRIZES

There are a total of 50 (fifty) prizes available to be won during the Contest Period, each prize consisting of a1 (one) Cineplex Movie Pass, each Prize retail valued at $13.

Entrants are each only eligible to win one (1) Prize during the Contest. There is a limit of one (1) Prize per person per residence.

Winners will be announced during the Contest Period.

Should a selected entrant fail to meet any conditions in these Official Contest Rules and Regulations, he/she will be disqualified. Scotia iTRADE reserves the right in its sole and absolute discretion to award prizes from amongst all remaining eligible entries in accordance with these Official Contest Rules and Regulations in order to select another entrant, who will be subject to disqualification in the same manner.

All dollar amounts mentioned are in Canadian dollars. A Prize must be accepted as awarded and is non-transferable. Scotia iTRADE reserves the right to substitute a Prize with one of equal or greater value and/or to terminate, modify or withdraw this Contest, in whole or in part (including altering the manner in which the Prizes are distributed), at any time, without prior notice for any reason including, but not limited to viruses, bugs, tampering or other causes beyond Scotia iTRADE’s control affecting the administration, security, fairness or proper play or conduct of the Contest. In the event a substitute prize is awarded, such prize must be accepted as awarded and cannot be exchanged for cash or otherwise. Scotia iTRADE will not be responsible if any factors beyond its reasonable control prevent a Prize from being fulfilled.

Scotia iTRADE reserves the right at any time to place reasonable restrictions on the availability or use of the Prizes. By accepting a Prize, a winner agrees to waive all recourse against the Releasees (defined below) if a Prize does not prove satisfactory, either in whole or in part.

CERTIFICATION AND ACKNOWLEDGEMENT

By entering the Contest, you certify that:

  1. You have read  and  agree to be bound  by these Official Contest Rules and Regulations;
  2. You agree to a complete release in favor of The Bank of Nova Scotia, its affiliates (including Scotia iTRADE), and partners described below;
  3. You acknowledge and agree that Scotia iTRADE may, in its sole discretion, disqualify your contest entry if it finds that (i) you have not complied with your certification in this section “Certification and Acknowledgement”, (ii) you have failed to meet or abide by, or violated, these Official Contest Rules and Regulations, or (iii) you have tampered with the entry process or any other component of the Contest, which conduct or action affects the administration, security or fairness, integrity or proper conduct of the Contest. Scotia iTRADE reserves the right to refuse a contest entry from any person whose eligibility is in question or who has been previously disqualified.

CHANCES OF WINNING

For a Prize, your chances of winning depend on the total number of eligible Scotia Tweets posted on Twitter during the Contest Period and on the time when such Scotia Tweets are posted. Scotia iTRADE’s decisions are final and binding in all respects on all entrants.

HOW TO CLAIM A PRIZE

Scotia iTRADE will contact the selected winner via Direct Message on Twitter within two (2) business days of the time such person’s Scotia Tweet is posted on Twitter and is verified by Scotia iTRADE. In the event that the selected winner does not claim his/her prize at Plaza Concourse, 44 King Street West, Toronto within ten (10) days of the receipt of the Direct Message from Scotia iTRADE, the selected winner will be disqualified and Scotia iTRADE reserves the right, in its sole and absolute discretion, to choose an alternate contest entry in accordance with these Official Contest Rules and Regulations.

Scotia iTRADE will award the prize winners during the Contest Period at the Plaza Concourse, 44 King Street West, Toronto, after verification of fulfilling the Official Contest Rules and Regulations by reviewing identification of age, province of residence and eligibility and by reviewing a copy of Scotia iTRADE Direct Message verifying the Scotia Tweet brought by the selected entrant. At such time, each selected entrant will be required to correctly answer, unaided, a time-limited mathematical skill-testing question to be administered on behalf of Scotia iTRADE and confirm his/her eligibility. The selected winners will be provided with, and will be required to sign and submit to Scotia iTRADE, the liability and publicity release form which releases the Releasees from any and all liability arising from, among other things: (i) participation in the Contest; and (ii) acceptance of the Prizes awarded therein; and (iii) the administration of the Contest and distribution of the Prizes awarded therein, and which may include, without limitation, authorization for Scotia iTRADE and its agents to announce and publish the selected entrant's name, address (city and province only) and/or photograph or image or other likeness, without further compensation, at any time and from time to time, in any future publicity.

Once these requirements are satisfied, selected entrants will be awarded the Prizes.

RELEASE OF LIABILITY

The Bank of Nova Scotia, its affiliates (including Scotia iTRADE), their partners, and all of their directors, officers, employees, agents, their respective and promotional agencies and partners, (collectively, the “Releases”) assume no responsibility for any failure or technical malfunction of any Web site, on-line computer systems of equipment, servers, access providers or software, poor reception or technical problems, or for any human or computer-generated error in the selection of an entrant or the awarding of the prizes. The Releasees further assume no liability for any injury or damage to an entrant's or any other person's computer or other property related to or resulting from participating in this Contest or from accessing, allowing or downloading any material relating to the Contest.

CONSENT TO USE OF PERSONALITY

Subject to applicable law, by entering the  Contest, you consent to the use of your  name, city of residence, photograph, voice, likeness, image  or any  other aspect of your  personality, for any  publicity and  programming purposes, commercial or otherwise, in all media  that  Scotia iTRADE uses, without territorial or time  limitations, and without payment or compensation. You give the same consent to Scotia iTRADE's affiliates, promoters and their advertising and promotional agencies.

CONSENT TO COLLECTION AND USE OF PERSONAL INFORMATION

Scotia iTRADE respects your right to privacy. By entering the Contest and voluntarily providing personal information including, but not limited to, name, e-mail address and telephone number (the “Personal Information”), you expressly consent to Scotia iTRADE, its agents and/or representatives, its affiliates and partners collecting, storing, sharing, using and disclosing the Personal Information for the purpose of administering the Contest and selecting Prize winners in accordance with Scotia iTRADEs privacy policy, available at http://www.scotiabank.com/itrade/en/0,,4263,00.html.

GENERAL TERMS AND CONDITIONS

(1) All entrants agree to follow these Official Contest Rules and Regulations, which are subject to change at Scotia iTRADE’s sole discretion. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws. Should such an attempt be made, Scotia iTRADE reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries which are incomplete or fraudulent are null and void.

(2) Any person who enters or tries to enter the Contest in a manner which is unfair to the other entrants will automatically be disqualified and could be referred to the appropriate authorities. The use of automated software or computer programs to register or enter this Contest is prohibited and any individual who uses or attempts to use such methods to register or enter will be disqualified. In the event it is determined that an entrant has entered in a fashion not sanctioned by these Official Contest Rules and Regulations, has made a misrepresentation, or has submitted more than the number of entries permitted by these Official Contest Rules and Regulations, the entrant will be disqualified. The use of an invalid email address will disqualify the entry. Users spamming the same email address will disqualify the entry.

(3) By entering this Contest, you agree to hold harmless The Bank of Nova Scotia, its affiliates (including Scotia iTRADE), advertising and promotional agencies, prize suppliers, directors, officers, employees, representatives and agents against any and all liability, damages or causes of action (however named or described) with respect to or arising out of: (i) your participation in the Contest, (ii) the receipt or use/misuse of the Prizes awarded therein; and (iii) the administration of the Contest and distribution of the Prizes.

(4) Scotia iTRADE does not assume any responsibility and will not be liable for any failure of the website or email during the Contest, tampering, theft, defects, viruses, human errors including negligence, deletions, technical or telephone, computer line, network, server, access providers, computer equipment or software problems, undeliverable messages, computer errors, lost, misdirected, late or incomplete entries or inaccurate capture of information or any online difficulties that may result in computer damage or malfunction of a telephone network or social media, computer, on-line systems, servers, access providers, computer equipment, software, or the failure of Scotia iTRADE to receive or process any email, on-line, or Internet entry and otherwise award the Prizes.

(5) In addition, Scotia iTRADE shall not be responsible for technical problems, traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer or property related to or resulting from playing or downloading any material on the Contest website. Entries are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.

(6) Scotia iTRADE is not responsible for printing errors appearing in these Official Rules and Regulations or related Contest materials. Scotia iTRADE reserves the right to correct clerical or typographical errors in promotional materials or these Official Contest Rules and Regulations.

(7) Scotia iTRADE will not assume any responsibility of any nature whatsoever in all cases where their inability to hold the Contest or to remit the Prizes to the winners results from a cause beyond their control, including Acts of God, weather conditions, strike, lock-out or other labour dispute.

(8) Scotia iTRADE reserves the right to cancel, terminate, modify or withdraw the Contest, or to amend these Official Contest Rules and Regulations at any time without prior notice. Scotia iTRADE can do this for any reason, including for any cause beyond its control that corrupts or affects the Contest's administration, security, fairness or proper administration.

(9) By accepting a Prize, the winner consents to the use of his/her name, personal information (Name, City, Province) and likeness for advertising and promotional purposes related to this Contest by Scotia iTRADE without further notice or compensation.

(10) In the event of any inconsistency between these Official Contest Rules and Regulations and any advertising or other materials related to the Contest, these Official Contest Rules and Regulations will govern.

(11) All entrants consent to the jurisdiction and venue of the Province of Ontario.

(12) The Contest is void where prohibited by law and is subject to all applicable Canadian federal, provincial and municipal laws and regulations.
