Contest Rules and Regulations

Open to residents of Ontario Only


1. NO PURCHASE IS NECESSARY

By entering this Contest (defined below), entrants agree to abide by these contest rules and regulations (the “Official Rules”). The decisions of the independent contest organization with respect to all aspects of the Contest are final. The Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, or Instagram. You understand that you are providing your information to the Sponsor (as defined below) and not to Facebook, Twitter, or Instagram. The information you provide will only be used to administer the Contest in accordance with the Sponsor’s privacy policy and will only be used by the Sponsor in connection with publicity relating to the Contest. Facebook, Twitter, and Instagram are completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not Facebook, Twitter, or Instagram.

2. SPONSOR & CONTEST PERIOD:

The Scotiabank Contact Festival Contest (the “Contest”) is sponsored by Scotiabank (the "Sponsor"). The Contest commences at 10:00:00 AM Eastern Time (“ET”) on May 2, 2016 and will end at 11:59:59 PM ET on May 23, 2016 (the "Contest Period"). All times are Eastern Times.

3. ELIGIBILITY:

To enter the Contest and be eligible to win a Prize (see rule 7), a person (“Entrant”) must be a legal resident of Ontario who at the time of entry has reached eighteen (18) years of age or older. Specifically excluded from entering the Contest are: (i) employees, shareholders, officers, directors, agents, representatives, and advertising and promotional agencies of the Sponsor, and each of their respective subsidiaries and affiliates; and (ii) a member of any such person’s immediate family (regardless of where they live) or persons with whom they are domiciled (whether related to the person or not). In these Official Rules, “immediate family” includes mother, father, brothers, sisters, sons, daughters, partner or spouse.

4. HOW TO ENTER:

No Purchase is Necessary. There are three (3) methods of entry into the Contest and they are as follows:

  • FACEBOOK: During the Contest Period, visit https://www.facebook.com/scotiabank/?fref=ts (the “Facebook Contest Website”). The Sponsor will post a comment regarding the Contest (the “Contest Post”) on the Facebook Contest Website at 10:00:00 AM ET on May 2, 2016 (the “Contest Start Date”). Click on the “comment” icon below the Contest Post to post a selfie photo (the “Photo”) at a Scotiabank Contact Photography Festival event taking place from May 2, 2016 to May 23 ,2016 in Toronto, ON (for a list of events taking place between May 2, 2016 and May 23, 2016, visit http://scotiabankcontactphoto.com/events) (the “Contact Festival Event”) to the Contest Post. Upon doing so, click “post” and your Photo will be posted to the Facebook Contest Website and will be considered an official entry (the (“Facebook Entry”) into the Contest. Entrants are subject to Facebook Terms of Service and Rules; these can be found at https://www.facebook.com/legal/terms. Sponsor is not responsible in any way for any decisions Facebook makes regarding the Entrant's account with Facebook.
    Multiple, separate posts contributed to the Contest Post will not increase the chances of winning. Anyone found to use multiple accounts to enter the Contest will be ineligible. Anyone found “spamming” by posting multiple unrelated updates or comments that are unrelated to the Contest discussion or by sending large numbers of duplicates to the Sponsor or the Contest Sponsor will be disqualified.

  • TWITTER: During the Contest Period, tweet a selfie photo at a Contact Festival Event (the “Photo”) with the hashtag #CONTACTselfie (the “Twitter Hashtag”) and mention “@Scotiabank” (a “Twitter Mention”) on Twitter from your Twitter account to submit a Twitter entry (the “Twitter Entry”) (subject to compliance with these Official Rules). A person may only tweet a Photo once and re-tweets will not be accepted. Entrants are subject to Twitter's Terms of Service and Rules; these can be found at https://twitter.com/tos. Sponsor is not responsible in any way for any decisions Twitter makes regarding the entrant's account with Twitter.
    To enter the Contest from your Twitter account, you must have a Twitter account and follow the Sponsor’s official Twitter account (@Scotiabank). To become a Follower of the Sponsor, you must access your Twitter account and search people for “Scotiabank” and click the “Follow” button corresponding to @Scotiabank. Multiple, separate tweets contributed to the Twitter Hashtag and/or any re-tweets of an entrant’s tweet will not increase the chances of winning. Anyone found to use multiple accounts to enter the Contest will be ineligible. Anyone found “spamming” by posting multiple unrelated updates or comments that are unrelated to the Contest discussion or by sending large numbers of duplicates to @Scotiabank will be disqualified.

  • INSTAGRAM: During the Contest Period, post a selfie photo at a Contact Festival Event (the “Photo”) with the hashtag # #CONTACTselfie (the “Instagram Hashtag”) and mention “@Scotiabank” (a “Instagram Mention”) on Instagram from your Instagram account to submit a Instagram entry (the “Instagram Entry”) (subject to compliance with these Official Rules). Entrants are subject to Instagram’s Terms of Service and Rules; these can be found at https://help.instagram.com/478745558852511. Sponsor is not responsible in any way for any decisions Instagram makes regarding the entrant's account with Instagram.
    Multiple, separate posts contributed to the Instagram Hashtag will not increase the chances of winning. Anyone found to use multiple accounts to enter the Contest will be ineligible. Anyone found “spamming” by posting multiple unrelated updates or comments that are unrelated to the Contest discussion or by sending large numbers of duplicates to @Scotiabank will be disqualified.

5. ENTRIES:

Please note, all posts or tweets submitted as an Entry through Facebook, Instagram or Twitter must be set to public and your Instagram Account must be set to public up until all winners are confirmed (see rule 9). A Facebook Entry, Instagram Entry and Twitter Entry will be herein collectively referred to as an “Entry”. Limit of one (1) Entry per method of entry per account per person during the Contest Period for a maximum total of three (3) Entries. You may only use one (1) Facebook account, one (1) Instagram account, and one (1) Twitter account to enter the Contest. Any person who is found to have entered in a fashion not sanctioned by these Official Rules and/or who has submitted more than the number of Entries permitted by these Official Rules will be disqualified. Proof of transmission (screenshots or captures, etc.) does not constitute proof of delivery. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. The Sponsor will not be responsible for late, lost, illegible, falsified, damaged, misdirected, mutilated, garbled or incomplete Entries, which will be void. All Entries become the property of the Sponsor upon receipt and none will be returned. Proof of posting or tweeting an Entry is not proof of receipt by Sponsor. Entries must be received by 11:59:59 PM ET on May 23, 2016 (the “Contest Close Date”) in order to be entered into the prize draws (see rule 8). In the event an Entrant posts or tweets inappropriate content, in the sole discretion of the Sponsor, he or she will be disqualified. Any Entries that do not satisfy the requirements set out in rule 6 will be removed and be ineligible for entry into the Contest.

6. PHOTO FORMAT AND CONTENT:

  • A FACEBOOK ENTRY:
    • Must be submitted in a JPEG or PNG file format;
    • Must be a selfie Photo of you at the Contact Festival;
    • Must be sent by clicking the “Comment” icon on the Contest Post posted to the Scotiabank Facebook page;
    • Must not be based on another person’s Photo;
    • Must comply with Facebook terms of use.
  • A TWITTER ENTRY:
    • Must be submitted in a JPEG or PNG file format;
    • Must be a selfie Photo of you at the Contact Festival;
    • Must include the Hashtag #CONTACTselfie;
    • Must include the Mention @Scotiabank;
    • Must be an original Tweet;
    • Must comply with Twitter terms of use.
  • AN INSTAGRAM ENTRY:
    • Must be submitted in a JPEG or PNG file format;
    • Must be a selfie Photo of you at the Contact Festival;
    • Must include the Hashtag #CONTACTselfie;
    • Must include the Mention @Scotiabank;
    • Must comply with Instagram terms of use.
  • FORMAT AND CONTENT: A Facebook Entry, Instagram Entry and Twitter Entry must:
    • be intended for family audience viewing and contain only content that, in the sole and unfettered discretion of the Sponsor, is suitable for all persons, including persons under the age of 13;
    • not contain any nude, sexually explicit, disparaging, discriminatory, libelous or other inappropriate content of any kind whatsoever;
    • not contain any content that promotes any product or service other than that of the Sponsor;
    • not contain any language suggesting or encouraging illegal activity;
    • not contain anything that infringes or that may infringe anyone’s rights, including intellectual property rights;
    • not contain any personal information;
    • not contain any identifiable third party products and/or trade-marks, brands, logos or copyright, other than those of the Sponsor.
    • not contain any copyrighted works (other than as owned by the eligible Entrant) or third party content that may be subject to and protected by intellectual property laws, including but not limited to music, artwork, video and photographs;
    • contain entirely original materials that have never before been distributed, shown publicly or published, or selected as a winner in any other contest;
    • not contain any reference to or likeness of identifiable third parties, unless consent has been obtained from all such individuals and such individuals are of the age of majority;
    • Must only be entered once.

By submitting a Photo that includes the Hashtag and the Mention on Twitter and/or Instagram and/or is posted to the Contest Post on Facebook, each Entrant warrants and represents that such content complies with these Official Rules. If you are using a Photo depicting a person other than yourself, you must first obtain the permission of that person to use their image. The onus for obtaining such consent rests entirely with the entrant. The Sponsor assumes no responsibility for obtaining such consent or for use of posted Photos.

7. PRIZES:

There will be four (4) prizes (each referred to as a “Prize” or collectively as “Prizes”) available to be won during the Contest Period. Each Prize consists of a signed copy of Angela Grauerholz’ (the 2015 Scotiabank Contact Photography Festival Winner) coffee table exhibition book with an approximate retail value of $75 (CDN).
Prizes must be accepted as awarded without substitution, are not transferable, not for resale and have no cash surrender value. The Sponsor reserves the right, in the event that a Prize cannot be awarded as described for any reason, to substitute another prize of equal or greater value, without liability. Limit of one (1) Prize per person.

8. PRIZE DRAWS:

One (1) random draw will take place at the independent contest organization in Oakville, ON at 2:00:00 PM ET on May 26, 2016 (the “Draw Date”) from among all eligible Entries received during the Contest Period to determine the four (4) selected entrants (each a “Selected Entrant”). The Sponsor will attempt to contact each Selected Entrant by sending a direct private message to the Selected Entrant’s Twitter, Instagram or Facebook account (depending on the method of entry) (collectively referred to as a “Private Message”) associated with the potential winning Entry within one (1) business day of the Draw Date. The Selected Entrant associated with the selected Facebook account, Instagram account or Twitter account will then be asked to reply via Private Message to provide his/her contact information including full name, email address, and telephone number (the “Contact Information”) within two (2) business days so that a declaration and release form (the “Release Form”) can be issued and so that a skill testing question can be administered (see below). If a Selected Entrant (a) does not reply via Private Message with his/her contact information within two (2) business days; (b) fails to correctly answer the skill testing question (see rule 9); or (c) fails to return the properly executed Release Form within the specified time (see rule 9), then he/she will forfeit his/her opportunity to be the Selected Entrant and another Entrant will be randomly selected and so on until there are no more eligible entries.

To be declared a Prize winner, each Selected Entrant must answer correctly, without assistance of any kind, whether mechanical or otherwise, a mathematical skill testing question. Each Selected Entrant will also be required to sign and return within five (5) business days of notification the Release Form, which (among other things): (a) confirms compliance with these Official Rules including eligibility requirements; (b) acknowledges acceptance of the Prize as awarded; (c) releases the Contest Parties and each of their respective agents and associated companies and each of their respective officers, directors, employees, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, the potential Prize winner’s participation therein and/or the awarding and use/misuse of the applicable Prize or any portion thereof; and (d) agrees to the publication, reproduction and/or other use of the potential Prize winner’s name, address, voice, statements about the Contest, photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast and the internet. Each Prize will be shipped to the applicable winner within thirty (30) days of receipt and verification of his/her Release Form to the address shown on the Release Form (and subject to compliance with all other condition and requirements provided in these Official Rules).

10. CONDITIONS OF ENTRY:

By entering the Contest, entrants (i) acknowledge compliance with these Official Rules including all eligibility requirements, and (ii) agree to be bound by these Official Rules and by the decisions of the independent contest organization, made in its sole discretion, which shall be final and binding in all matters relating to this Contest. Entrants who have not complied with these Official Rules are subject to disqualification.

11. GENERAL:

The Releasees do not assume any responsibility for (i) the incorrect or inaccurate capture of entry information and entries that fail to comply with these Official Rules; (ii) any loss, damage, or claims caused by an awarded Prize or the Contest itself; or (iii) any failure of the Facebook Contest Website or other sites during the Contest Period, including any problems, human or technical, printing errors, lost, delayed, garbled data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone or computer lines, or technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person's computer related to or resulting from downloading any material connected to the Contest, all of which may affect a person’s ability to participate in the Contest. Entry material/data that has been tampered with or altered is void.

12.

All issues and questions concerning the construction, validity, interpretation, and enforceability of the Official Rules, or the rights and obligations of entrants and the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflicts of law principles. Any attempt by an Entrant or any other individual to deliberately damage any website or undermine the legitimate operation of the Contest could be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. This Contest is subject to all applicable federal, provincial, and municipal laws.

13.

In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and disclosures or other statements contained in any Contest related materials, including, but not limited to point of sale, print or online advertising, the terms and conditions of these Official Rules shall prevail, govern and control to the fullest extent permitted by law.

14.

The Sponsor reserves the right to terminate or suspend this Contest or to amend the Official Rules at any time and in any way, without prior notice, for any reason whatsoever. Without limiting the foregoing, if for any reason the Contest is not capable of running as originally planned, for example as a result of tampering or infection by computer virus, the Sponsor reserves the right to terminate the Contest and conduct a random draw from all previously received eligible entries.

15. CONSENT TO USE PERSONAL INFORMATION:

The Sponsor respects your right to privacy. The information you provided will only be used for the purpose of administering this Contest and prize fulfillment.
